TERMS OF SERVICE
This agreement establishes the terms and conditions for the use of the LÝFT GÝM service provided by LYFT Inc. This Agreement applies to all individuals who use the LÝFT GÝM service. Before using the LÝFT GÝM service, please read the contents of this Agreement carefully. Those who do not agree to this Agreement cannot use the LÝFT GÝM service.

1.INTRODUCTION AND DEFINITIONS

LÝFT GÝM (hereinafter referred to as "the Club") is a fitness club operated under the name "LÝFT GÝM" by LYFT Inc. Members (referred to as "Members" hereafter) are individuals who have entered into a contract with the Company following the procedures stipulated in Article 4 of these Club Regulations. These regulations apply to the use of the fitness club "LÝFT GÝM," its facilities, and the operational activities associated with it. Members of the Club are considered to have already agreed to these regulations when using the Club.

2.DEFINITIONS

This club is operated and managed by LYFT Inc. (hereinafter referred to as "the Company").

3.Membership System

  • This service can only be accessed by members whom the Club has granted admission.
  • Members are granted admission and the right to use the Club by entering into a membership contract with the Club.
  • The Club establishes the membership categories, operational scope, usage fees, terms and conditions, and provided services, including the creation, modification, or discontinuation thereof.
  • If a member falls under any of the conditions mentioned in the preceding section, the member must immediately notify the Club or the Company of such circumstances.
  • If a member has incorrect information in their registration or if changes occur, the member must, through the methods specified by the Club, notify the Club of such errors or changes, or make the necessary corrections or changes on this service.
  • The Club or the Company, if it is determined that any of the reasons listed in the second paragraph occur after the commencement of service use, or if there is a violation of the provisions of these regulations, can immediately take the following actions:
    ① Suspension of the use of this service by the member (including the suspension of all services provided based on this service).
    ② Termination of the usage contract with the member.
  • The Club or the Company may refuse admission if an applicant falls under any of the following conditions or if there is a reasonable suspicion that they do, as determined by the Club or the Company. However, the Club and the Company are not obligated to provide a reason for such refusal.
  • Individuals who cannot comply with this agreement and the various regulations of the Club.
  • Individuals for whom it cannot be confirmed that they are the same as the members stated in the application.
  • Individuals whom the Company has determined to be associated with organized crime groups or anti-social forces.
  • Individuals who have been prohibited from exercising by a medical professional or similar authority.
  • Individuals who have infectious diseases or other conditions that may be contagious or pose a risk of infection to others.
  • Individuals attempting to join for purposes other than training, such as for investigations by competitors.
  • Individuals who have unpaid debts for past membership fees, administrative fees, usage fees, etc., individuals who have previously received suspension or termination of use under Article 9, individuals who have had their usage registration for this service or other services by the Company denied or canceled, or individuals who have violated contracts or other agreements with the Company.
  • Individuals for whom joining a fitness club is prohibited by their affiliated school or organization.
  • Individuals who cannot agree to the "confirmation items," "consent items," or similar terms included in the membership application form, and so on.
  • Other individuals whom the Company or the Club has deemed unsuitable for membership.
  • Individuals under the age of 18.

4.Membership cards

  • The Club will issue a membership card to its members.
  • Members are required to present the membership card, as approved by the Club, when using the facility (including the necessary procedures). In principle, if a member does not have their membership card, they may not enter the facility.
  • Members are not allowed to lend their membership card to third parties. Lending the membership card to others may result in expulsion from the Club.
  • If a member loses their membership card, they must promptly report it to the Club and apply for a reissue.
  • Reissuing the membership card will incur a reissuance fee of 5,500 yen (tax included), payable to the Club.
  • A membership card will be issued to Week Pass members. In the event of non-return, the Club reserves the right to charge a card loss fee of 3,300 yen (including tax) without prior notification.

3.Membership and Resignation

5.Membership

  • Individuals wishing to use the services of the Club shall apply for membership through the Club's exclusive website (hereinafter referred to as the "exclusive website") after agreeing to these regulations.
  • When becoming a member, individuals are required to register their name, date of birth, gender, contact phone number, current address, emergency contact information, and any information necessary for membership fee payment during the membership application process.

6.Personal Information Protection

The Company will handle the personal information of members in a proper manner in accordance with a separately specified "Privacy Policy."

7.Loss of Membership Qualification

Members will lose their membership qualification if they fall under any of the following conditions.

  • When they have completed the resignation procedure as stipulated in the following article.
  • When they have been subjected to a contractual resignation as determined in Article 9.
  • When the member personally passes away.
  • When the Club is closed.

8.Resignation

  • If a member wishes to resign from the Club voluntarily, they must come to the Club in person or through a legally authorized representative, complete the required procedure by filling out the designated application form, and they will be able to resign at the end of the month. Requests made via telephone, email, fax, or other electronic means will not be accepted.
  • The resignation procedure must be completed by the 10th of the month in which resignation is desired. In such cases, resignation will take effect at the end of that month. If the resignation procedure is initiated on the 11th of the month or later, the resignation will be processed at the end of the following month.
  • Resignation is possible from the month following the month of joining. Resignation cannot be processed in the same month in which a member joined.
  • For membership through promotional campaigns, the specific conditions may vary for each campaign. Please check the details of the campaign for further information.

9.Forced Resignation

The Club may implement "Forced Resignation" in the following circumstances:

  • When there is a violation of laws, the Club's regulations, or any other rules established by the Club.
  • When there is defamation of the Club's honor or disruption of its order.
  • When there is intentional or significant negligence resulting in the destruction of the Club's facilities, equipment, etc.
  • When a member has been in arrears with various membership fees specified in Article 13 for a period of two months and has not made the payment even after being requested to do so. After the forced resignation, any outstanding amounts must be paid in full, either in cash or by the method specified by the Club.
  • When a member's actions, such as not following staff instructions, disrupt the operation of the Club.
  • When false statements have been made during the membership application or various notifications.
  • When a member engages in behavior that causes inconvenience or annoyance to other members or the staff.
  • When there is a violation of the prohibited actions stipulated in Article 20.
  • When the Club deems that a member is not suitable for membership for other reasons.

10.Suspension of Membership and Reinstatement

  • Members may apply for a temporary suspension (leave of absence) by completing the designated application form and submitting it to the club. Requests made through phone, email, fax, or any other means will not be accepted.
  • Members are allowed to take a leave of absence for a minimum of 6 months to a maximum of 1 year on a monthly basis, and their membership will automatically be reinstated upon the expiration of the declared period. Please note that the specific duration will be determined at the discretion of the staff.
  • 休会は月単位で最大1年(12ヶ月)まで可能であり、届け出た期間の満了をもって自動で復会します。
  • 休会中の復会・延長は、当クラブが定める期日までに所定の受付フォームに入力することで申請が可能です。復会および延長については、電話・メールでの申し出も受け付けます。

11.Change of Declaration Details

  • The member shall guarantee the accuracy of the information provided at the time of joining. The club shall not be held responsible for any damages incurred by the member or third parties as a result of inaccurate information.
  • Members are required to promptly notify the club of any changes to the information provided at the time of joining.
  • 会員は、当クラブが定める申請期間内に所定の受付フォームに入力することで会員種別の変更が可能であり、電話、メール等による申し出は受け付けません。

4. Fee

12.Enrollment fee

The entrance fee shall be the amount determined separately by the club. Please note that once paid, the entrance fee will not be refunded except as required by the law or as permitted by the club.

13.Membership fee

  • The monthly membership fee, suspension fee, and optional charges (for contract lockers, rental equipment, etc.) (hereinafter collectively referred to as "various membership fees") shall be the amounts determined separately by the club.
  • A member is obligated to pay the regular various membership fees as determined by the club, even if they are not actively using the club's services, as long as the withdrawal procedure in Article 8 has not been completed.
  • Various membership fees must be paid in full for the entire month, even if withdrawal occurs in the middle of the month.
  • If a member wishes to make changes to their various membership fees contract, they must notify the club by the deadline specified by the club each month using the method specified by the club.
  • Once paid, the various membership fees will not be refunded except as required by law or as deemed appropriate by the company.

5.Facility usage

14.Closing days

As a general rule, this club is closed on the fourth Wednesday of every month.

15.Temporary closure and discontinuation of operations

  • In the event of closure or changes to our club facilities, the club will not provide any special compensation to its members.
  • Our club may temporarily close, partially close, or make changes due to the following reasons.
  • When the company or the club determines that members are affected by such weather or disasters, and it is deemed difficult to operate.
  • When the facility is closed for maintenance, inspection, repair, or renovation.
  • When there are reasons beyond the control of the club, such as the enactment or amendment of laws and regulations, government directives, significant changes in the socio-economic situation, or other unavoidable operational circumstances.
  • When unavoidable operational circumstances arise within the club, the club may dissolve after giving a three-month notice. However, in cases where the reason for dissolution is a natural disaster, major geological event, government order, compulsion, or other force majeure, the aforementioned notice period may be reasonably shortened.

16.Non-member club usage" or "Club usage by non-members."

  • The club allows individuals other than members (referred to as visitors/week) whom members accompany or whom the company has approved through specified procedures to use the club, provided they meet the following conditions.
  • Individuals who meet the membership qualifications in Article 3.
  • Individuals who, when using the club, present identification and have paid the visitor/week usage fee as specified separately.

17.Handling of Lost Property, Abandoned Property, and Personal Items

  • Regarding valuable items such as cash and precious metals, they will be held as lost property for a certain period and then submitted to the nearest police station. For other abandoned items, the club will dispose of them after the storage period specified by the club has passed. However, if there are separate regulations (such as the building management company's rules), those will be followed.
  • When a member resigns from the club (including resigning according to the terms and conditions), any personal belongings within the club premises must be taken by the member until the final day of club usage.
  • If a member, after resigning (including resigning according to the terms and conditions), does not come to retrieve their belongings within the club premises one month after resignation, the member is considered to have abandoned ownership of those items, and the club may remove and dispose of those items. In such cases, the member may not raise any objections.

18.Liability for Compensation

  • For accidents occurring within the club, such as loss, theft, or injury, the company and the club, except in cases of intentional or gross negligence, shall not be held responsible.
  • Members and visitors/week users must promptly fulfill their liability for compensation if they cause damage to the club or third parties due to reasons attributable to themselves.

19.Matters Concerning the Use of the Club

  • Members, when using the club, agree to comply with the rules of the establishment.
  • Members, within the club, can take photos and videos to a reasonable extent, following the establishment's rules, but the use of tripods or similar equipment is not allowed. Members must also ensure that third parties, including other members, are not captured in such media. In the event that third parties are captured, members are obliged to promptly delete the respective photos or videos to avoid infringing upon third parties' rights, including their portrait rights, privacy, honor, and other rights and interests.(Revised on July 31, 2023.)
  • Members can post photos and videos taken in accordance with the above section to social media. However, if, regarding such photos and videos, the company determines that certain conditions specified below are met, the company may request the member to remove the posts and the data. In such cases, the member is obliged to promptly comply with the company's request.
  • If the photos or videos infringe or have the potential to infringe on the intellectual property rights, portrait rights, privacy, honor, or other rights or interests of the company or third parties.
  • If the photos or videos violate the establishment's rules.
  • If the use of the facilities is inappropriate.
  • In cases equivalent to the above points or other cases determined by the company as inappropriate.

20.Compliance and Prohibitions

Members must adhere to the following in addition to the regulations outlined in this agreement:

  • Members must follow the rules listed at each facility, customary rules, and the explanations and instructions provided by the staff at each facility when using the club.
  • Members must adhere to the dress code when using the club. The following clothing is prohibited:
  • Clothing, footwear, accessories, or decorations that may damage the facility or equipment (e.g., items with rivets).
  • Clothing, footwear, accessories, or decorations that lack elasticity, are slippery, or may get caught in equipment, and are unsuitable for training (e.g., sandals, clogs, high-heeled shoes, slippery shoes, jeans, etc.).
  • Clothing, footwear, accessories, or decorations that may potentially harm members or other members.
  • Attire that exposes the upper or lower body, goes barefoot, or consists of only underwear or similar attire.
  • Other attire, footwear, accessories, or decorations deemed unsuitable by the company.

The club prohibits the following actions by members within the facility:

    • Actions that violate laws, club regulations, various rules, and regulations.
    • Actions when suffering from infectious diseases or similar conditions.
    • Members with tattoos (body art) are allowed to join, but in case of extensive exposure, they must wear T-shirts or long T-shirts. If the exposure exceeds the stipulated limit, the staff may issue a warning, and if clothing is not worn as required, the member may be asked to leave in accordance with the terms of use. *Please note that for event-invited athletes and similar cases, facility usage is approved by the company's responsibility, so please understand.
    • Photography and videography within the club are subject to the provisions in Article 19. Commercial photography requires separate approval.
    • Unauthorized commercial activities, solicitation, lending or borrowing of money, political activities, signature campaigns.
    • Defamation or slander of others or staff.
    • Acts of violence, harassment, or intimidation against others or staff.
    • Any other attire, footwear, accessories, or decorations deemed unsuitable by the company.
    • Stalking behavior towards others or staff.
    • Acts that unreasonably disrupt staff's work through meetings, phone calls, or other methods without valid reasons.
    • Behaviors that disrupt facility usage, such as shouting or making loud noises.
    • Acts that violate public morals or decency, such as groping, voyeurism, or indecent exposure.
    • Damaging, defacing, or removing equipment or items belonging to the club.
    • Bringing animals into the facility, except for assistance dogs approved by the company for use in this club.
    • Bringing dangerous items like knives or explosives into the facility.
    • Entering the facility under the influence of alcohol or consuming alcohol or smoking within the facility.
    • Engaging in criminal activities or aiding and abetting such activities.
    • Any other actions deemed unsuitable by the club as a member.
    • Stalking, following, or approaching other members or gym staff without a legitimate reason.
    • Actions that cause damage or harm to the club or its services.
    • Collecting information that can identify individuals or the membership information of other members through this service.
    • Using this service for commercial purposes or to benefit third parties.
    • Illegally accessing or attempting to access the company's website, network, or system.
    • Any other actions equivalent to those mentioned above.
    • Acts that directly or indirectly lead to or facilitate the actions listed above.

    In case of a violation of any of the above, the club may immediately expel the member and visitor users."

      6.Miscellaneous

      21.Notifications and Contact

      • The club can communicate with members about club-related matters through its website, telephone, email, or other methods determined by the club.
      • Members, unless otherwise specified in this agreement, should generally use the email address they have provided to contact the company regarding club-related notifications, inquiries, and other communications.

      22.Amendment of the Terms and Conditions

      The club reserves the right to amend the terms and conditions, detailed regulations, usage rules, or other matters related to the club's operation and management. The latest revision date will apply to all members.

        23.Jurisdiction

        In the event of a lawsuit between the club or the company and a member, the Tokyo District Court or the Tokyo Summary Court will have exclusive jurisdiction as the court of first instance by mutual consent.Please note that this is a general translation, and specific legal or contextual nuances may require a more precise translation depending on the intended use and jurisdiction.

          Basic Services

          Introduction:

          This document provides an explanation of the services offered by LÝFT GÝM (hereinafter referred to as "the Club"). The Club's services are divided into three categories: Basic Services, Personal Training Services, and Optional Services. The document will provide descriptions of each service's content and conditions.

          (1)Service Content

          • WEEK PASS ¥22,000 (tax included)
          • STANDARD PLAN ¥22,000 (tax included)
          • ADVANCED PLAN ¥33,000 (tax included)

          ※ The Subscription service is a recurring service that, once you subscribe, continues automatically unless canceled by the specified deadline.

          (2)Consideration for Services (User Fees)

          1. Overview

          You will be required to pay an enrollment fee and a monthly membership fee. If you choose to use Optional Services, additional fees may apply. More details can be found in the explanation of Optional Services below.

          2. Explanation of Fees

          • Enrollment Fee: ¥22,000 (tax included), payable upon enrollment.
          • Monthly Membership Fee: For Basic Services, you must pay the following amounts as the next month's membership fee at the end of the previous month:
            ・STANDARD PLAN: ¥22,000 (tax included)
            ・ADVANCED PLAN: ¥33,000 (tax included)

            Regarding pro-rated fees:
            At the time of signing the contract, you will be required to pay the enrollment fee, the monthly membership fee for the contract month (pro-rated based on the remaining days of the month), and the full monthly membership fee for the following month. Pro-rated fees are calculated based on the number of days in the month.

            For example, if you sign up for the Standard Plan on June 15th, you will pay the following fees:

            Enrollment fee: ¥22,000 (tax included).
            Monthly fee for the contract month (June) is calculated as follows:
            ¥22,000 (tax included) ÷ 30 days × remaining days (16 days) = ¥11,000 (tax included).

            Additionally, you will pay the next month's monthly fee (July) in full, which is ¥22,000 (tax included), on June 30th.

            From the third month onwards (starting with August), you will pay each month's fee of ¥22,000 (tax included) on the last day of the previous month (e.g., February 28th, March 31st, etc.).

          (3)Explanation of Fees by Payment Timing

          Payment upon Enrollment:

          • Enrollment Fee: ¥22,000 (tax included)
          • Monthly Membership Fee: Contract month's monthly membership fee (pro-rated based on the remaining days)

          The payment at the end of each month following the contract date.

          • Monthly fee: From the second month onwards, the monthly fee.

            (4)Payment Methods

            • Online: Credit card and Debit card payment only.

            (5)Start Date of Use and More

            You can start using our services from the day your membership registration is complete and the contract for service use is established, provided that you have paid all the necessary membership fees and other fees on the day of application. *Please note that certain procedures are required after your visit.

            (6)Contract Termination (Resignation)

            • To terminate the Basic Services contract, you must complete the termination process at the Club's physical locations. We do not accept termination requests via the website, phone, email, or fax. If the termination process is completed by the 10th day of the month in which termination is requested, the contract will be terminated at the end of that month. If the process is completed after the 10th day, the contract will terminate at the end of the following month.
            • Refunds: Enrollment fees and monthly membership fees, by their nature, are not refundable, except as otherwise provided in the terms of use or applicable laws.
            • There are no contract termination fees.
            • Your membership card will be deactivated but can be retained by you after the process is complete.

            (7)Suspension of Use

            • You may suspend your use of our services by completing the required procedure in person at the Club's physical locations or through a legally authorized representative. We do not accept suspension requests via the website, phone, email, or fax. Please note that suspensions are only available for periods longer than three months of continuous use.
            • Suspension procedures must be completed by the 10th of the month preceding the desired start month of the suspension. The suspension will take effect on the 1st of the requested month. A suspension fee of ¥2,200 (tax included) per month will be charged.
            • During the suspension period, you will not be able to use the Club's facilities.
            • You can suspend Basic Services for a period of up to one year per suspension procedure, on a monthly basis (6 months to 12 months).
            • If you have been on suspension, you will automatically return to using Basic Services as they were before the suspension, starting from the day after the end of the suspension period. However, you must pay the service fee for the return month (pro-rated based on the number of remaining days) before the return date.
            • Service Fee for the Return Month (pro-rated based on the number of remaining days): During the suspension period, you are exempt from paying membership fees and other fees. However, a monthly suspension fee of ¥2,200 (tax included) will be charged. The suspension fee must be paid by the 10th of the month preceding the desired suspension month and at the end of each month starting from the next month of the suspension period.
